Under the Control of Asbestos 2006 legislation, anyone responsible for commercial premises, including the common parts of residential properties, has a legal duty (deemed as the duty holder) to identify and produce a management plan and register for any asbestos that may be present in the property. Failure to comply with this legislation is a criminal offence, punishable by a fine of up to £5,000, 5 years imprisonment, or both.
There are 2 types of asbestos survey:
Management Survey: Required for most properties to establish the presence of asbestos, its type and assess its condition and risk to health.
Refurbishment / Demolition Survey: Required prior to any refurbishment or demolition. This is an intrusive survey and will result in sampling of the fabric of the building and all areas affected by the works.
