Under the Control of Asbestos Regs 2006, anyone responsible for commercial premises, (including the common parts of residential properties), has a legal duty (deemed as the duty holder) to identify and produce a management plan and register for any asbestos that may be present in the property.  Failure to comply with this legislation is a criminal offence punishable by a fine of up to £5,000, 5 years imprisonment, or both.

 

Health & Safety Executive:

“Every building manager must have a survey and management plan in place by May 2004 or substantial fines may be imposed.  Asbestos will be dealt with the same gravity as a Legionnaires disease outbreak”.

Asbestos is the greatest single cause of work-related deaths in the UK.
